1Introduction & Acceptance of Terms
Welcome to WeConsent ("we", "us", "our"). By downloading, installing, or using the WeConsent mobile application or website (collectively, the "Service"), you agree to be legally bound by these Terms & Conditions of Use ("Terms").
WeConsent is a consent verification platform that enables individuals and organisations to request, give, and record clear, mutual consent. We provide identity verification, secure communication, and digital record-keeping to ensure trust and safety.
If you do not agree to these Terms, do not access or use the Service.
These Terms constitute an End User License Agreement ("EULA") between you and WeConsent Ltd. Where the Service is accessed through the Apple App Store, Apple Inc. is not a party to this EULA and has no responsibility for the Service or its content. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
2Eligibility
- You must be at least 18 years old to use WeConsent.
- You must have the legal capacity to enter into a binding contract in your jurisdiction.
- You must provide accurate, truthful information and maintain a valid identity verification profile to access verified features.
- If you are accessing the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3Required Transparency & Disclosure
WeConsent requires users to disclose their gender and gender identity truthfully. This is fundamental to our commitment to creating a safe, transparent environment where consent is informed and mutual.
Users who are not comfortable sharing this information cannot complete identity verification and will have restricted access to the platform's core features.
4Why We Ask for Your Information
WeConsent is built on one principle: mutual trust through transparency. Your information helps to:
- Build mutual trust between users
- Prevent misunderstandings or misrepresentation
- Create a safe environment for dating, intimacy, and other consent scenarios
- Support informed consent — a cornerstone of our platform
Your details are securely stored and never visible to the public. They are only shared with the person you engage in a consent request with, and are protected under our Privacy Policy.
5Subscriptions & Payments
WeConsent offers the following access tiers:
- Free: Creating a profile and basic browsing is free.
- Verified (Subscription): A monthly or annual subscription is required to access identity verification and the full suite of consent features.
Payments are processed securely via the Apple App Store, Google Play Store, or other trusted third-party providers (Stripe, Apple Pay, Google Pay).
Auto-Renewal Disclosure: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your payment method on file will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions at any time in your device's Account Settings or the App Store / Google Play account settings. No refund is given for any unused portion of a current subscription period.
If you subscribed via the Apple App Store, cancellation and refund requests must be directed to Apple in accordance with their policies. If you subscribed via Google Play, cancellation and refund requests must be directed to Google in accordance with their policies. Direct subscriptions managed by WeConsent may be cancelled by contacting support@weconsent.app.
6Acceptable Use
When using WeConsent, you agree that you will not:
- Use the platform for illegal, harmful, abusive, or exploitative purposes.
- Misrepresent your identity, age, or gender, or impersonate any other person.
- Attempt to hack, reverse engineer, decompile, disassemble, or disrupt the Service.
- Coerce, harass, pressure, or manipulate other users into giving consent.
- Upload, share, or transmit any content that is defamatory, obscene, or unlawful.
- Use automated tools, bots, or scripts to access or interact with the Service.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
7Consent and User Responsibility
- Consent must always be clear, mutual, and freely given.
- Consent may be withdrawn at any time before or during any interaction.
- WeConsent provides tools to document and confirm consent but does not police or guarantee personal interactions. Responsibility for individual behaviour rests entirely with users.
- WeConsent records are not a substitute for legal evidence and should not be relied upon as such without independent legal advice.
8Intellectual Property
The Service, including all software, designs, text, graphics, logos, and content, is owned by or licensed to WeConsent Ltd and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service strictly in accordance with these Terms.
You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written consent.
Any content you upload to the platform ("User Content") remains your property. By uploading User Content, you grant WeConsent a non-exclusive, royalty-free, worldwide licence to store and process that content solely to deliver the Service to you.
9Privacy and Data
- All personal data is encrypted at rest and in transit.
- We do not sell or share user data with third parties for marketing purposes.
- Users may delete their account and associated data at any time via the app or by contacting us.
- Full details are set out in our Privacy Policy, which forms part of these Terms.
10Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, WeConsent disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11Limitations of Liability
- WeConsent is a tool to facilitate clear communication; we are not responsible for the outcomes of user interactions.
- WeConsent is not a legal contract platform, nor a substitute for professional legal, medical, or psychological advice.
- To the maximum extent permitted by law, WeConsent's total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
- WeConsent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of your use of the Service.
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
12Third-Party Claims (App Store)
In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, WeConsent (not Apple or Google) will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
Apple and Google are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
13Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms or if your conduct compromises the safety or integrity of the platform or its users.
You may terminate your account at any time by deleting the app and contacting us at support@weconsent.app to request account deletion. Termination does not entitle you to a refund of any subscription fees paid.
14Dispute Resolution
We encourage you to contact us first at support@weconsent.app to resolve any concerns informally.
If a dispute cannot be resolved informally, UK/EU users may refer the matter to the relevant national consumer protection authority or alternative dispute resolution (ADR) body. US users may pursue available remedies under applicable state or federal law.
15Governing Law
- UK/EU users: These Terms are governed by the laws of England & Wales. Any disputes not resolved informally will be subject to the exclusive jurisdiction of the courts of England & Wales. These Terms comply with GDPR.
- US users: These Terms are governed by applicable US federal and state laws, including CCPA where applicable.
16Changes to These Terms
WeConsent may update these Terms from time to time. We will notify users of material changes via in-app notification and/or email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you do not agree with the revised Terms, you must stop using the Service and may cancel your subscription before the changes take effect.
